These terms of use (“Terms and Conditions”) mandate the terms on which the users (“You” or “Your” or “User”) access and register on the webPlatform. The term “Yaanna”, “We”, “Us”, “Our” shall mean Yaanna and its affiliates. Please read the Terms of Use and Privacy Policy carefully before registering on the Platform or accessing any material, information through the Platform.

1. Use of Platform

You must be at least 18 years old to use this Platform. By using our Platform, you represent and warrant that you meet this requirement. You agree to use the Platform for lawful purposes only and not for any purpose that is prohibited by these Terms or applicable laws.

2. Account Registration

To make a purchase or access certain features, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate and complete. You are responsible for safeguarding your account login credentials and for any activities or actions under your account. We are not liable for any loss or damage arising from your failure to maintain the confidentiality of your account information.

6. Disclaimer of Warranties

Our products and services are provided “as is” and “as available” without warranties of any kind, either express or implied. While we strive to ensure the quality and safety of our products, we do not make any warranties regarding specific results or suitability for your individual type.

7. Limitation of Liability

To the fullest extent permitted by law, Yaanna shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Platform or products purchased through the Platform.

8. Privacy

Your use of the Platform is also governed by our [Privacy Policy], which outlines how we collect, use, and protect your personal information.

9. Indemnity

You agree to defend, indemnify and hold harmless Yaanna, its employees, officers, agents and their successors and assigns, from and against any and all claims, liabilities, damages, losses, costs and expenses, including attorney’s fees, caused by or arising out of claims based upon your actions or inactions, which may result in any loss or liability to Yaanna or any third party including but not limited to breach of any warranties, representations or undertakings or in relation to the non-fulfillment of any of your obligations under the Terms of Use, or arising out of the your violation of any applicable laws, regulations including but not limited to Intellectual Property Rights, payment of statutory dues and taxes, claim of libel, defamation, violation of rights of privacy or publicity, loss of service by other subscribers and infringement of intellectual property or other rights.

10. Jurisdiction for Sale

Unless otherwise mentioned, the products on the Platform are presented solely for the purpose of sale in India. 

11. Governing Law

These terms shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of courts, tribunals, applicable authorities at Ahmedabad. The place of jurisdiction shall be exclusively in Ahmedabad.

12. General

You acknowledge and hereby agree to these Terms and Conditions and that it constitute the complete and exclusive agreement between Us concerning your use of the Platform, and supersede and govern all prior proposals, agreements, or other communications.

Yaanna reserves the right, in its sole discretion, to change/ alter/ modify these Terms at any time by posting the changes on the Platform. All changes are effective immediately upon posting to the Platform. Your continued use of the Platform constitutes your agreement to all such changed Terms.

In the event that any provision of these Terms shall be unenforceable or invalid under any applicable law or be so held by any applicable arbitral award or court decision, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole but these Terms shall be modified, to the extent possible, by the adjudicating entity to most fully reflect the original intent of the parties as reflected in the original provision.
